Article 11
The Company shall, at any time during the currency of this Agreement or any
extension thereof, have the right by giving notice to the Shaikh in writing to take
up a concession for the area covered by this Agreement on terms to be mutually
agreed between both parties.
Article 12
If the Company shall be unable at any time during the period of this Agree
ment to exercise its rights under this Agreement in so far as such inability arises
from force majeure, the period during which the Company shall be unable so to
exercise its rights together with such period as may be necessary for the restoration
of any damage done during the continuance of a state of force majeure shall te
added to the period of this Agreement.
Force majeure as used in this Agreement includes the Act of God, war,
insurrection, riot, civil commotion, tide, storm, tidal wave, flood, lightning,
explosion, fire, earthquakes and any other happening which the Company could
not reasonably prevent or control.
Article 13
Subject to the provisions of Article 12 hereof the Shaikh shall have the right to
terminate this Agreement if the Company shall fail to make any of the payments
prescribed in this Agreement within 6 months of the date on which they fall due.
Article 14
If at any time during the currency of this Agreement or any extension thereof
any difference or dispute shall arise between the parties concerning the interpre
tation or execution thereof, or anything herein contained or in connection herewith
or the rights or liabilities of either party hereto, the same shall, failing any agreement
to settle it in any other way, be referred to one arbitrator who shall be selected by
mutual agreement between the Shaikh and the Company. In the event of failure
to agree upon an arbitrator, both parties shall accept one nominated by the British
Political Resident in the Persian Gulf.
Article 15
The Company shall make all payments that become due to the Shaikh under
this Agreement into the Shaikh’s account at the British Bank of the Middle East,
Dubai, and the Bank’s receipt shall be a full discharge for the Company in respect
of the payment of the sum stated in the Bank’s receipt.
Article 16
This Agreement is written in English and translated into Arabic. If there
should at any time be disagreement as to the meaning or interpretation of any
clause in this Agreement the English text shall prevail.
In witness whereof the parties to this Agreement have set their hands the
Day and Year first written.
