 M                    IVI       THI* LEGAL STATUS OF THE ARABIAN GULF STATES

                        The Provisional Constitution provides for the promulgation of
                      substantive civil and criminal laws for the Union. It is understood
 *1                   that a number of such laws are now in the process of preparation.
   ■                    So far as the Emirates are concerned, modern legislation in them
                      appear to be very limited. The Rulers of these Emirates appear to
                      adopt Islamic law as their legal system. They regard the principles of
                      Shari'a law, derived from the Holy Qur'an and the Hadith (the
  r:i                 Prophet's expressed opinions) as the main source of legislation.
                      However, under the pressing conditions of modern life, the Rulers
                      have found it necessary to pass certain enactments touching on such
                      important matters as taxes, customs, traffic and labour. These
                      enactments, referred to as ordinances, were also applied to persons
                      subject to the Trucial Orders 1959 to 1969, before their termination
  • •                 in December 1971. The said ordinances, which became effective in
                      respect of all persons, were adopted in the following Queen’s
                      Regulations:

                      The Traffic Ordinance (Abu Dhabi), 1964, as amended in 1965-66;1
                      The Trucial States Application of Law and Transfer of Jurisdiction
                      (Abu Dhabi Traffic) Regulation 1969;2 The Trucial States Transfer
                          ' ’nsdiction (Dubai Traffic) Regulation 1968;3 and the Trucial
                              'Sharjah Traffic) Regulation 1968; The Abu Dhabi
                                's Compensation Ordinance, 1965 ;4 The Trucial States
                                  Compensation Ordinances, (Dubai, Sharjah, Ajman,
                                   'ain, Ras al-Khaimah and Fujairah), 1965 ;5 The Dubai
                                   rdinance, 1965;6 The Abu Dhabi Labour Law 1967;7
                                   icomeTax Regulation, 1969; The Ajman Income Tax
                                   59, and the Umm al-Qaiwain Income Tax Regulation

                               .don to the above mentioned enactments, the Emirate of
                           Jfiabi has, since 1969, produced a number of substantive laws
                       covering civil and criminal matters. These laws include: Law No. 2
                      for 1968 on the Organisation of the Courts;10 Air Navigation Law of
