TI O N 4 Ministerial Review Process
The ministerial review process applies to projects that require little to no
E C discretion in making a decision, which in essence involve checking that
a project complies with specific regulatory standards. These are typically

building permits that are issued soon or long after legislative or discretionary
actions have occurred entitling a project to be built. These permits are issued
by staff and are intended to ensure compliance with adopted regulations
and approved discretionary entitlements. An important part of the ministerial
review process is to ensure public health, safety and welfare through
application of adopted uniform building and fire codes, along with engineering
standards.
The Coastal Zone
Most of Encinitas is within the Coastal Zone, which was established by the
State of California and is administered by the California Coastal Commission.
In many cases, ordinarily routine projects require an additional level of review
to obtain a Coastal Development Permit (CDP). Typically a CDP does not
significantly complicate a project entitlement or building permit. Encinitas has
an adopted Local Coastal Program and therefore has been delegated permit
decision-making authority, except in very specific circumstances directly
affecting coastal resources. Although the Coastal Zone in Encinitas is large,
only limited areas are within the Coastal Commission’s appeal and original
permit jurisdictions.
