Dispute Resolution

The aim and purpose of this phase and function is to independently provide parties to the relationship
with a fair, independent and objective adjudicative process. This includes mechanisms such as
mediation, pre-trail conferences and an internal hearing - a similar approach to the function of the
CCMA in South African labour disputes. Statistics show that an informal approach minimizes any
litigation costs by up to 85% for both parties. Should there be any dispute after the conclusion of the
adjudication process, where both parties have participated in this process, then such aggrieved party
may refer the dispute for arbitration.
