Actions prohibited by this order shall be cause for disciplinary action, up to and
including dismissal.
D. Training (Updated 8/28/2017)
1. Officers shall complete all training required by state law regarding bias based
profiling. (TBP 2.01)
2. Officers will receive education and training on racial profiling that is
consistent with Sections 1701.253 and 1701.402, Texas Occupations Code,
and with Section 96.641, Texas Education Code. (Added 8/28/2017)
3. The department will review on a continual basis the need for further training
relating to racial profiling issues. (Added 8/28/2017)
4. The Training Unit shall ensure that all training mandated by statute and by
this directive have been completed. (Added 8/28/2017)
V. COMPLAINTS (Updated 8/28/2017)
A. The Department publishes a compliment or complaint brochure along with a
complaint affidavit on how to make a complaint against an officer. These brochures
and forms are readily available in the Police Department lobby as well as on the City’s
web-site www.redoaktx.org. The Department’s complaint process and its bias based
profiling policy are posted on the Department’s website. Whenever possible, the
media and social media will be used to inform the public of the Department’s policy
and complaint process. These documents shall serve as public education relating to
the complaint process and shall provide a telephone number, address and e-mail
address to the complainant to assist in filing a complaint in regards to a ticket, citation
or warning issued by an officer. (Updated 8/28/2017)
B. Complaints alleging incidents of bias based profiling will be fully investigated as
described under Policy 2.4.
C. An allegation of racial profiling is a serious charge, which could have a devastating
impact on the accused officer, regardless of the merits of the allegation. Therefore,
complaints of racial profiling will be investigated thoroughly and expeditiously.

D. On the commencement of an investigation by the department of a complaint
alleging racial profiling, the department must furnish the accused officer a copy of
any existing videotape or other recording of the related stop, upon written request
by the officer. (Art. 2.132(f), Texas Code of Criminal Procedure.) (Added 8/28/2017)
E. Complainants will be notified of the results of the investigations when such
investigation is completed.
