3. The mobile recording device will be operated in accordance with
established procedures.
B. Retention
1. All mobile recordings will be maintained for at least 90 days.
2. If a complaint is filed with the department alleging that a Red Oak officer
has engaged in racial profiling, any mobile recording of the related motor
vehicle stop will be retained until the final disposition of the complaint.
VIII. MOTOR VEHICLE STOP DATA SHEET (INCIDENT-BASED DATA) (Added

A. Required Use (Added 8/28/2017)
1. An officer will provide incident-based data sheet on the electronic form on
the MCT for each motor vehicle stop the officer conducts. (Added 8/28/2017)
2. The incident-based data required to be collected by the department shall
minimally include the information required to be collected under Art. 2.321,
Texas Code of Criminal Procedure. (Added 8/28/2017)
B. Retention (Added 8/28/2017)
1. The incident-based data shall be retained to complete the annual racial
profiling report. (Added 8/28/2017)
2. If a complaint is filed with the department alleging that a Red Oak officer
has engaged in racial profiling, any incident-based data completed related
to the motor vehicle stop will also be retained to assist with the investigation

IX. RECORD KEEPING AND REQUIRED REPORTS (Updated 8/28/2017)
A. The Department will maintain all required records on motor vehicle stops where a
citation or warning is issued or where an arrest is made subsequent to a motor vehicle

B. The information collected above will be reported to the City Council annually.
C. The information collected above will be reported to the Texas Commission on Law
Enforcement (TCOLE) not later than March 1 of each year in an annual report of
the incident-based data collected under section VI, in accordance with Art. 2.134,

D. The purpose and content of the report shall be in accordance with Art. 2.134, Texas

1. evaluate and compare the number of motor vehicle stops, within the city’s
jurisdiction, of persons who are recognized as racial or ethnic minorities;

2. examine the disposition of motor vehicle stops made by officers employed
by the department, categorized according to the race or ethnicity of the
