B. INVESTMENT GUARANTEE AGREEMENT
BACKGROUND
1. The Malaysia-Qatar IGA negotiation process started in
2010 when BDPFP submitted a MJM to Cabinet to seek
mandate on:
i. Proposal to revise/improve the current IGA template
following the dynamic nature of investment and
Malaysia’s commitments in various FTAs; and
ii. Malaysia to initiate IGA negotiation with 38 countries.
2. The chronology of IGA negotiation with Qatar is as
follows:
i. Malaysia’s new IGA model text was sent to Qatar
in July 2010;

ii. the 1 round of IGA negotiation with Qatar was
held in Kuala Lumpur in May 2012;

iii. the 2 round was held in Kuala Lumpur in April
2014; and
iv. progress was minimal as both sides shared
different understanding on number of the
provisions. Qatar disagrees on Malaysia’s
requirements, as follows:
- carve-out from scope for Government
Procurement (GP) and subsidies;
- National Treatment (NT);
- Most Favoured Nation (MFN);
- Transfer; and
- Minimum Standard of Treatment.
