Stay of Proceedings
• Where a subsequent prosecution is brought on the same
facts, generally, the Court should exercise its power to stay
the second prosecution on the grounds of abuse of process,
see:
Connelly v. DPP [1964] A.C. 1254;
R v. Beedie [1998] Q.B. 356; and
Bennett v Horseferry Road Magistrates' Court and
another - [1993] 3 All ER 138
