DISCUSS
The appellant, the headmaster of a boarding school,
was charged on two counts with offences involving
a 16 year old boy, S, and a 17 year old boy, H, both of
whom were pupils at the school. Count 1 charged
the appellant with buggery with S and count 2
charged him with inciting H to commit buggery with
him. The counts were tried together and both S and
H gave evidence. There was no suggestion that S
and H had collaborated together to concoct a
similar story. Each boy gave evidence that the
appellant had visited the boy's dormitory in the
early hours of the morning and invited the boy to go
with him to his sitting room and that the appellant
had asked each boy to take the active part, while
the appellant took the passive part, in acts of
buggery.
