Employer's Liability (Claims-made Basis)
EMPLOYER'S LIABILITY (CLAIMS-MADE BASIS)
1. UNDERSTAND THE RISK
1.1 Compensation for Occupational Injuries and Diseases Act (Act 130 of 1993) is to provide for compensation in the case of disablement caused by occupational injuries and diseases, sustained or contracted by employees in the course of their employment, or death resulting from such injuries and diseases; and to provide for matters connected therewith.
1.2 Employees who are injured on duty or obtain an occupational disease can claim compensation for temporary or permanent disablement. Should an employee succumb to their injuries sustained on duty, their dependants will also be entitled to claim compensation. Employers that registered their employees are protected against civil claims in this regard.
1.3 The COIDA basically prevents employees covered by the act from suing their employers for damages in terms of common law.
1.4 As this has not yet been proven in court, Employer's Liability cover is still offered as a fail-safe.
2. UNDERWRITE THE RISK
2.1 Number of employees and limit of indemnity is to be provided by the Insured.
2.2 Check whether the occupation of the risk is on the referral or decline list.
2.3 If the business occupation is of a hazardous nature, ensure the correct premium is charged.
2.4 The limit of indemnity must never be greater than the Public Liability limit under the Combined Liability section.
2.5 The retroactive date must be noted on the Schedule. This will usually be the same as the inception date of the policy.
3. MINIMUM PREMIUMS
The premiums noted in the table below are annualised. For monthly premiums, divide by 12.
