ADMINISTRATION OF RELATED ENTITIES SCHEDULE
16. Control of My Non-Fixed Trusts (if any)
16.1 If at the date of my death, I hold Effective Control of any of My Non-Fixed Trusts, or shares in,
any company acting as trustee (“the Corporate Trustees”) for any of My Non-Fixed Trusts:
a) I appoint My Executor to assume Effective Control; and
b) I gift any shares I own in the Corporate Trustees to My Executor.
16.2 My Executor shall then be required to pass Effective Control and to pass shares in the
Corporate Trustees in respect of My Non-Fixed Trusts to one or more persons nominated in
this Will as a beneficiary (or to another person or entity as directed by such beneficiaries)
during the Administration Phase of My Estate.
16.3 For the purposes of the preceding subclause, the net value of such of My Non-Fixed Trusts
whose control passes shall be adjusted accordingly to ensure that my Aggregate Wealth is
divided amongst my beneficiaries as intended and in doing so, My Executor is directed to have
regard to the terms of the Adjustment of Aggregate Wealth Schedule.
16.4 If necessary, My Executor shall arrange a share split of the shares in the Corporate Trustees to
give effect to the provisions of this clause.
16.5 This clause shall not apply if control of My Non-Fixed Trusts for the period commencing after
my death has already been determined (other than by the appointment of my Legal Personal
Representative) by the provisions of the trust deed, a deed of succession or a resolution of the
trustee during my lifetime.
17. Control of Self-Managed Superannuation Funds (if any)
17.1 If at the date of my death, I hold any shares in a company acting as trustee (“the SMSF
Corporate Trustees”) for any of My SMSFs, I give such shares to My Executor.
17.2 It is my strong wish that, without binding any party, My Executor does all in their power to
ensure that:
a) They become either trustees or directors of the SMSF Corporate Trustees; and
b) The terms of any valid binding death benefit nomination that I may have executed in
respect of My SMSFs is complied with.
