Gun Possession Charge Nets Man 15-Year Sentence
A federal judge sentenced a Tampa man to prison for being a felon in possession of a firearm. He pleaded guilty to the charge October 21, 2014.
Last week, U. S. District
Judge Elizabeth a. Ko- vachevich sentenced 33- year-old Justin Robinson to 15 years in prison.
According to court docu- ments, on April 28, 2014, around 3:45 a.m., a Hillsbor- ough County Sheriff’s deputy observed Robinson hiding behind a van outside an apart- ment complex.
Robinson reportedly told the deputy that he was in the area visiting a friend. How- ever, residents living in the complex Robinson said he

was visiting told police they did not know Robinson.
The deputy found a loaded .9 mm firearm on the ground
where Robinson had been hiding. The deputy ordered Robinson to place his hands behind his back, but Robin- son ran. He was taken into custody after a short foot chase.
Law enforcement later de- termined that the firearm had been stolen during a residen- tial burglary.
Robinson had been con- victed on several felonies prior to his arrest that included three drug trafficking charges. Because of his convicted felon status and the new gun posses- sion charge, Judge Ko- vachevich sentenced Robinson under an enhanced penalty under the Armed Ca- reer Criminal statute.
Jail Employee, Two Others Sentenced In Tax Fraud Scheme

Three individuals were sentenced to federal prison last week. All three were charged with are linked to an income tax scam that took place in the Manatee County area.
U. S. District Judge James S. Moody, Jr., sen- tenced the three for stolen identities and federal income tax refunds that took place between 2012 and 2013.
Judge Moody also en- tered a $15,457 money judg- ment against Marcus Lowe, 32, of Tampa, along with Ms. Rachel Kerley, 36, and Tedrick Randall, 44, both of Bradenton.
According to court docu- ments, Lowe was employed by the Manatee County Pa- role Services Division and as- signed to the Manatee County Jail. His responsibilities gave him access to jail booking records that contained per-

sonal information of the in- mates.
Lowe was arrested on January 22, 2015. He was found guilty during a jury trial on May 1, 2015. Lowe was convicted of providing the information to his co-de- fendants, Ms. Kerley and Randall.
Ms. Kerley and Ran- dall then used the informa- tion to file false income tax returns in the names of the inmates. They filed false claims seeking approximately $72,254.
Lowe was sentenced to 3 years and six months in prison.
Both Ms. Kerley and Randall pleaded guilty to their role in the crime in April 2015. Ms. Kerley was sen- tenced to 6 months in prison. Randall was sentenced to 3 years and 1 month for his role in the scam.
Two Men Sent To Prison For Theft Of Federal Weapons
Two Tampa men sentenced to federal prison in connection with the thefts of weapons be- longing to agents with the Fed- eral Bureau of Investigations.
James Weed, 24, was sentenced to 5 years and 9 months for the theft of more than $1,000 in federal govern- ment property. The offense took place on May 3, 2014.
According to his plea agreement, Weed gained ac- cess to a gated community and removed a Remington 12- gauge shotgun, a box of rifle bullets, two bullet-proof vest, three loaded magazines for a Glock handgun, handguns, a bag containing 5 boxes of am- munition, and other items. He was arrested after being pulled

over in Pasco County in a stolen vehicle. Some of the items that had been reported were recovered in the car.

ing a firearm and ammunition after a felony conviction and the theft of government prop- erty.
Court documents showed on Christmas morning, several cars were broken into in the Boyette Springs subdivision in Riverview.
One of those vehicles was assigned to an FBI agent. Among the items stolen were three firearms, ammunition, and body armor. Police found a blood stain inside the vehicle and a DNA test matched the blood stain to White.
White was sentenced to 7 years, 8 months in federal prison in connection with the charges.
Florida Investment Advisor Pleads Guilty
WASHINGTON --- bay area investment advisor pleaded guilty Thursday to perpetrating a $9 million investment fraud scheme involving Facebook stock.
Gignesh Movalia, 40, of Tampa, a registered invest- ment advisor, pleaded guilty before U. S. Magistrate Judge Anthony E. Porcelli of the Middle District of Florida to one count of investment advi- sor fraud.
Movalia was the founder and manager of OM Global In- vestment Fund LLC (the OM Global Fund), an investment fund formed in 2009.
According to admissions made in connection with his guilty plea, beginning in or about 2011, Movalia began so- liciting investments for the OM Global Fund by, among other methods, touting access to pre- initial public offering (IPO) shares of Facebook Inc.
Movalia admitted that, by the end of 2012, he had raised
more than $15 million for the OM Global Fund, and that more than $9 million of the amount raised was for “side pocket” investments, which Movalia represented were to be used exclusively for pur- chasing of Facebook shares.
Movalia further admitted that, contrary to these repre- sentations and unknown to “side pocket” investors, he used funds designated exclusively for the purchase of Facebook shares for other investments, which he concealed from the investors. He also admitted that he made material misrep- resentations and omissions to investors in order to mislead them about the nature and value of their investments in the OM Global Fund. The OM Global Fund lost approxi- mately $9 million before it went into receivership in Sep- tember 2013.
A sentencing date has not been set.
