Criteria for filing a lawsuit in federal or state court






         • Jurisdiction


            – The authority of a court to entertain a particular case
            – Types include in personam and in rem jurisdiction

            – A person or entity being sued becomes subject to jurisdiction when served with a complaint
                and summons

         • Standing to sue


            – Party initiating a lawsuit must have a legally protected interest at stake in the litigation, must
                have suffered a harm or injury or been threatened, and the controversy must be real and
                substantial
         • Venue


            – Determines which trial court in the court system will hear the dispute
