DISCIPLINARY RULES AND REGULATIONS
SECTION 1. FILING OF COMPLAINT.
A. A complaint or grievance against any member of Myakka Pines Golf Club Englewood, Inc., may be filed by any other member(s) in good standing or an active employee of MPGC. When the complainant is an employee, the complaint must be countersigned by the General Manager or a member of the Board.
B. An employee complaint regarding another employee is referred to the General Manager. Employee Handbook procedure is employed to resolve the complaint.
C. For a complaint filed by a member(s) in good standing against an action of the Board, the procedures provided in these Rules and Regulations will be followed to the extent applicable. i.e. Investigation conducted by Ad Hoc Committee where committee members are members in good standing.
D. Any complaint must include:
1. The date presented to a Board member or President of the Board,
2. The facts and circumstances of the alleged offense with date, time, place, particulars of
occurrence, supporting evidence, and must be stated in concise form and with reasonable
certainty, and
3. Be signed by the member(s) filing the complaint.
E. Complaints must be presented in writing, to a member of the Board or directly to the President by: 1. A member(s) in good standing, or
2. An active employee(s) and their complaint must be countersigned by the General Manager.
F. Any complaint presented to a Board member will be promptly forwarded to the President of the Board of Directors.
SECTION 2. BOARD DETERMINATION ON REFFERAL FOR INVESTIGATION. A. If the President determines the complaint is of a personal nature, he/she designates all
communication to be CONFIDENTIAL. All Board members, Grievance or Ad Hoc Committee members, and other members and people who may be interviewed will be reminded that all discussions and correspondence are required to be kept CONFIDENTIAL and all documents are labeled CONFIDENTIAL. The President forwards the complaint to Board members.
B. If the complaint cites an alleged action by a Board member(s) the President recuses the cited Board member(s) from all complaint/Grievance procedure deliberations. The President forwards the complaint to Board members.
C. If the President determines the complaint does not require immediate action, he/she will schedule it for the next Board meeting’s Executive Session. If the President determines that immediate action is required, he/she will call, a Special Meeting. The Special Meeting may be in person, with optional video conferencing, or conducted by e-Mail.
D. At the Board meeting the complaint shall be read and:
1. If deemed by vote to justify investigation, the complaint is referred to the
Grievance Committee or to an Ad Hoc Committee. When required Ad Hoc Committee members are designated by the President and approved by the Board. The Ad Hoc Committee members select Chairperson. The President will, when forwarding the case for investigation and a recommendation, send written instructions to the Grievance or Ad Hoc Committee along with pertinent information that is germane to the complaint. The President instructs the Secretary to send:
a. The accused a letter, See Section 6.A. below, and
b. The complainant a letter, See Section 6.B. below.
2. If deemed by vote investigation is not required, the Board then determines the validity of
the complaint:
a. When the Board determines the complaint is invalid, it follows that no disciplinary
action is warranted, and the President instructs the Secretary to send:
