Interviews conducted of attendees at a tradeshow from 1988 revealed that there was
a prototype of the machine in question displayed and featured—a full eight years
before the invention was claimed to have occurred. The patent was invalidated, but
not before plenty of proof was provided to the court. Former employees of the now-
defunct company had to be located and interviewed, and statements had to be taken.
Old computers were sent to forensic computer experts so files and drawings could be
mined from data in media formats that are no longer used. In this case, legal
investigators were very involved in the process and helped to successfully defend
against a claim of patent infringement.
Patent infringement defense investigations are not for the investigator who is content
to sit as his or her computer and do research. Investigating these cases takes
creativity, stamina and most importantly, a willingness to dig deeply for information in
atypical places.
