years of age or older, the notice shall include a
statement that the Superintendent may seek to
permanently exclude the student if the student is
convicted of or adjudicated a delinquent child for
that violation.
2. If the decision is made, to expel the student, the following
shall occur:
The Superintendent, within one (1) school day after the
time of the student's expulsion, shall notify in writing the
student's parent, guardian, or custodian of the expulsion.
The written notice is to be signed by the Superintendent
and shall be sent to the student's parent, guardian or
custodian, and Treasurer of the Board. Such written
notice shall:
a. specify the duration of the expulsion and the
reason(s) therefore (including date, time place and
nature of the misconduct);
b. include notification of the right of the student or
student's parent, guardian or custodian to appeal
the expulsion to the Board of Education or its
designee, to be represented in all appeal
proceedings, to be granted a hearing before the
Board or its designee to be heard against the
expulsion, and to request that the hearing be held
in executive session;
Such appeal shall be made in writing to the
Treasurer of the Board of Education.
c. indicate the appeal must be filed within fourteen
(14) days of receiving the notice of expulsion;
d. include notification that the expulsion may be
subject to extension, if the student is sixteen (16)
years of age or older;
e. contain a statement that the Superintendent may
seek to permanently exclude the student if the
student is convicted of or adjudicated a delinquent
child for the violation, if the offense is one for which
the District may seek permanent exclusion.
A student expelled for more than twenty (20) days or for
any period of time if the expulsion will extend into the
following semester or school year shall, in the notice
required above, provide the student and the student's
