A press release on February 13 from the HBPA of Ontario stated that the Economic Development and Tourism Corp. (EDTC), the Town of Fort Erie and the HBPA of Ontario had offered Nordic Gaming Corp. a $2,250,000 non-refundable down payment towards the purchase of Fort Erie Race Track for $35 million.

The down payment was in exchange for a commitment from Nordic to run 78 days of live racing in 2009 beginning on their traditional opening day of the  rst Sunday in May (May 2, 2009).
In a statement from HBPA President Sue Leslie released February 24, she stated that, “The EDTC did NOT withdraw the offer. The offer made to Nordic had an 11 am on Monday February 23 deadline. Nordic failed to respond by that deadline.
Nordic was to also give the parties until August to review with the Province of Ontario the formation of a not-for-pro t corporation stating that this would allow all concerned to perform due diligence to secure a permanent solution for Fort Erie Race Track.
“The Province is the key to the ongoing success at Fort Erie. The Province & our regulator, the ORC, are fully apprised of the developments.
A deadline date of February 23 was issued to Nordic in which time they would have to submit their response to the offer.
“We, the horsepeople, and particularly, right now, the Fort Erie horsepeople are amazingly committed. You are resilient, proud and dedicated to both our industry and especially to the horses. Now, you have also demonstrated incredible patience.
