EMPLOYMENT AUTHORIZATION VERIFICATION
Overview
The employer sanctions provisions, found in section 274A of the Immigration and Nationality Act (INA), were
added by the Immigration Reform and Control Act of 1986 (IRCA), requiring employers to only hire individuals
who may legally work here: U .S . citizens, noncitizen nationals, lawful permanent residents, and aliens authorized
to work, thus creating the Form I-9 . These provisions continued to change with the passage of the Immigration
Act of 1990 and the Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA) of 1996 . To comply with
the laws, employers must verify the identity and employment authorization of each person they hire, complete and
retain a FORM I-9 Employment Eligibility Verification for each employee, and refrain from discrimination against
individuals on the basis of national origin or citizenship . (See the section on unlawful discrimination for more
information .)
The Form I-9 - At A Glance
The Form I-9 is used for verifying the identity and employment authorization of individuals hired for employment
in the United States . Both employees and employers must complete the I-9 . The employee must attest to his or
her employment authorization . The employee must also present his or her employer with acceptable documents
evidencing identity and employment authorization . The employer must examine the employment eligibility and
identity document(s) an employee presents to determine whether the document(s) reasonably appear to be genuine
and to relate to the employee . The employee will then record the document information in Section 2 of the I-9 .
E-Verify - At A Glance
The E-Verify program is an internet-based system that compares information from the Form I-9 to government records
to confirm that an employee is authorized to work in the United States . This initiative is a partnership between
the Department of Homeland Security (DHS) and the Social Security Administration (SSA) . U .S . Citizenship and
Immigration Services (USCIS) (the agency in DHS responsible for immigration services) administers the program .
What is the Difference Between the Form I-9 and E-Verify?
E-Verify is closely linked to Form I-9 and exists to strengthen the Form I-9 employment eligibility verification process
that all employers, by law, must follow . While participation in E-Verify is either state required or voluntary, completion
of Form I-9 is required of all employers .
Why Use E-Verify?
FRC uses E-Verify to screen every new employee . Using E-Verify ensures a legal workforce, protects jobs for
authorized workers, deters document and identity fraud, and works seamlessly with Fom I-9 .
Completing the Electronic I-9:
Fox Restaurant Concepts uses a third party service (Equifax - I-9 Express) to adhere to our I-9 requirements .
In addition, the E-Verify process will be completed for every new employee .
