LEGAL CONSIDERATIONS DUTY OF CARE
There is no legal requirement for First Aiders or members of the public to stop and render assistance to an injured or ill person as a duty of care under Australian Law, unless it is under the following circumstances where:
• You are responsible for staff and customers in a workplace. In this case you are required to provide reasonable assistance to the best of your ability.
• You are a person who is trained in first aid and has taken responsibility for another individual e.g. in a Child Care facility.
• You are an employee who is trained in first aid and designated as a First Aider in your workplace.
• You are the driver of a motor vehicle that is involved in an accident where another person is injured.
• You have already commenced first aid on a casualty. A First Aider cannot abandon assistance partway through and must continue to care for the physical well being of the person in their care until handover to Emergency Services personnel.
