Deprivation of liberty
Protecting vulnerable patients
The Deprivation of Liberty Safeguards include provisions to protect vulnerable adults aged 18 and over who are, or may become, deprived of their liberty during a stay in hospital or care home. A person’s liberty can be judged as deprived if they:
• Lack the capacity to consent to their treatment • Are under continuous supervision and control • Are not free to leave where they are or where
they live.
If you’ve any concerns, or are made aware of concerns from someone else, that a patient in, or soon to be admitted into, your care may need to be deprived of their liberty to enable treatment, you must immediately initiate the deprivation of liberty safeguards process, details of which you can find on the intranet.
