5. ABSENCE FROM WORK
5.8 Medical Certificates (Statements of fitness for work / fit note)
The Company reserves the right to request a doctor’s medical certificate (fit note) for all periods of illness and may withhold Company or Statutory Sick Pay if it is considered that there may be abuse or misinterpretation of the rules, or if the absence procedure is not followed. For the rules on back dated medical certificates (fit note) please see section 5.5 above.
5.9 Persistent Illness
If absence due to illness is considered persistent, frequent or prolonged, Thomas Franks reserves the right to request that you attend an independent medical examination or, that you give your permission for a medical report to be obtained from your doctor. It is a condition of your employment that you attend any such examination and that your permission to obtain a medical report, is not with held. This procedure will form part of an investigation process which will help to decide your capability to carryout your duties. Your employment may necessarily be terminated if, due to your condition, you are unable to fulfil your contractual duties.
5.10 Unauthorised Absence
At Thomas Franks we rely on each other and expect all our colleagues to attend work unless the absence is pre-agreed or as a result of genuine illness. Any period or periods of absence considered to be unauthorised, unreasonable or unwarranted, for whatever reason, will be treated as a breach of contract and as such will be investigated and treated as a serious disciplinary matter. No pay will be given for such periods of absence.
5.11 Long-Term Absence
Long Term illnesses are considered to be absences in excess of four weeks. All longterm absences will be referred to the people and training department for advice and guidance. In these circumstances, you will be required either to undergo an independent medical examination or we will seek your permission to request a medical report from your Doctor. It is a condition of your employment that you attend any such medical or provide the necessary permission for a report to be provided.
