APPLICATION FOR ASSISTANCE OF A M KENZIE FRIEND
PART 5:CHRONOLOGV OF INSURANCE CLAIMS
70. Soon afterwards the Claimant received a telephone call from a man whom he described
to LPJS as "very he/pful"who assured him the AIG claim - accepting permanent lifelong
disability - would be approved without delay-49 at four times gross salary.
71. On 21 October 2016 the Claimant's licence was revoked and his employment with
st
easyJet came to an end. On 28 October 2016 AIG paid him £525,397.60. The Claimant
th
should have advised Cirencester of this but is not believed to have done so until at least
May 2018.
72. On 28 October 2016 at 15.13 the Claimant sent an SMS to LPJS embedding a
th
photograph of his Nat West balances, a smiling emoji and the words "shit shit" and listing
the balance on his accounts as follows:
• 42632862 Instant Saver £0.42
• 16574702 Select + OD Control £0.00
• 166652185 Premium Saver £320,075.47
• 61362881 Rewards Black £533,817.15
At 15.13 LPJS responded 50 "Shit @@@" contrasting her account balance of a
negative £1,188.44 with the Claimants.
He responded at 15.24 and 15.25
"Oh. it's all oud so you don't need to worry!!! Let's work towards the next BIG
1
ONE!!!!"
73. This confirms that - despite already being paid around £900,000 in damages - the
Claimant's priority was to maximise recovery from Diamond Insurance. He also stated the
money was "ours": implying that he had given half to LPJS.
74. He described the Diamond Insurance policy, among other things as:
52
• "worth millions"
• "life changing and his golden opportunity";
• His "one chance to escape from flying";
75. The Claimant's enthusiasm was restrained by LPJS's advice and his anxiety that the AIG
53
54
policy would come to light or that he would be required to complete forms or make
declarations containing falsehoods for which he had no plausible excuse. The more
Diamond Insurance delayed settlement, the more anxious the Claimant became although
he was still determined to maximise his pay-out.
49 This w//1 be covered In LP JS's statement
:;;o Jokingly/
51 He expected compensation of over £3 million
52 WIii be Included In witness statements
53 Which was never welcomed
54 This Is LPJS's current Interpretation, but she was not aware of the facts at the time. She knew at the time he was
worried but did not know the reason
