                January 2020


                The court heard from Nicholas Anderson, counsel for the Claimant and from the first Defendant as a
                litigant in person. The second Defendant was not present and was not represented


                The judge considered the papers in the bundle prepared for this hearing by the solicitors for the
                Claimant


                The judge also read the position statement on behalf of the Claimant and the position statement of
                first Defendant, neither of which had been included in the bundle. Both were returned to the parties
                by the court at the conclusion of the hearing.


                The court conducted an FDR-type hearing and a Costs & Case Management Conference

                The Claimant no longer pursues a claim in relation to the first Defendant's dental work and the
                Particulars of Claim shall stand varied as set out in paragraph 1 below.

                The first Defendant made an oral application inviting the court to consider making (i) orders for the
                specific disclosure of the Claimant's wills and tax returns and (ii) an order against Diamond
                Insurance. The court declined to consider these oral applications for specific disclosure or for an
                order against Third Parties pursuant to CPR Part 31.17, indicating that any such application should be
                made in writing, on notice and following the process of disclosure set out in the order below.

                The court declined to restrict the number of witnesses upon whose evidence the parties may rely
                pursuant to this order

                BY CONSENT IT IS ORDERED THAT:

                   1. The Particulars of Claim shall stand varied as follows:
                           a. the last six words of paragraph 18 shall be omitted. The paragraph shall end after
                              the words "children of the Defendants".
                           b. The figure in paragraph 19 and in paragraph (b) of the Prayer shall stand varied so as
                              to read "£75,509.01".
                       For the avoidance of doubt, the court does not require the Claimant to file a formally
                       amended Particulars of Claim.


                   2. The first Defendant's application application to allow her father to act as a McKenzie friend
                       at this hearing is allowed.
