I am dictating this so please excuse any typos.
The reality as I saw it was as follows:
We retained what we believed was specialist counsel to advise us. He repeatedly pointed out weaknesses in
your case and the likelihood that the court would;
• permit a clean break because of your nine year relationship with Sigve (in the eyes of the court,
equivalent to a marriage)
• care less that the children had come out of private education (for us all this was a red line which
could not be crossed)
• rule that the house would eventually have to be sold or that you would have to remortgage it to get
APMS of the documentation
• award some or all of Anthony's costs against you and they would continue to accumulate an
amazing rate. If you did not pay them they could sue you and force you to sell the house within
weeks.
Judge Todd had said (according to Richard Balchin) that if he had to rule on the case neither party would be
happy; which is the way it is in most cases I have ever attended. Very seldom does justice emerge
The thing that finally swung me was looking at the work that Richard had done (or rather not done) on
your case. He had never downloaded the full bundles he asked for (he said "oh yes I have, a number of
times"). We Transfer records when files are downloaded and opened. He has never even downloaded the
main documentation. Even the main bundle he had in his fucking bag had not been annotated. You may
recall that when he first came into the cafe he started plonking stickers on some folios with his hands flashing
backwards and forwards like a demented dervish. 1 looked at the tabs he had marked and they are
completely meaningless.
His understanding of the case bordered on appalling.
Also he did not have a single note about our case or even a notebook. He has never produced any sensible
narrative, nor had he prepared you for your evidence or state how he intended to cross examine APMS.
I don't know what Anthony's current counsel is like but Miss Fox would have completely outgunned him
and you would have had a very hard time in the witness box. Even though you are a lovely person with a
strong case and would tell the truth you would be given a much harder time by his counsel than he would
buy Richard.
