who have received conditional offers of employment with the Company. Refusal to participate in any of this Drug
and Alcohol-Free Workplace Policy will constitute grounds for immediate termination of employment.
Rules Regarding Unauthorized Drugs and Alcohol
“Unauthorized drugs” are defined as any controlled substances
considered unlawful under the Controlled Substances Act, or the
metabolite of the substance, including, but not limited to,

barbiturates, amphetamines, opiates, hallucinogens, marijuana,
cocaine, or PCP. The term “unauthorized drugs” does not include
any drugs lawfully prescribed by a health care provider and used
as prescribed.
Employees may not possess unauthorized drugs or engage in the
unauthorized use of drugs while on duty, while working, while on
Company property, or while operating Company or customer
equipment, machinery, or vehicles. Employees may not work or
report to work with detectable levels of unauthorized drugs or the
metabolites of unauthorized drugs in their systems. Employees
may not manufacture, distribute, dispense, transfer, or sell
unauthorized drugs.
“Alcohol” means ethanol, isopropanol, or methanol.
Employees may not consume alcohol during working hours, while
working or while on Company property without permission of the
Company Chief Executive Officer or Chief Technology Officer.
Employees may never consume alcohol while operating Company
or customer equipment, machinery, or vehicles.
Employees may not report to work under the influence of alcohol.
Drug and Alcohol Impairment Testing
The Company will pay for all applicant and employee drug and
alcohol impairment tests that it requests or requires. Employees
and applicants may be required to provide specimens for drug and alcohol testing under any of the following
circumstances:
Reasonable Suspicion
The Company may require any employee to undergo drug and alcohol impairment testing if management has a
reasonable suspicion that the employee:
• Has violated the Company’s written Policy prohibiting the use, possession, sale, or transfer of alcohol and/or
unauthorized drugs while on duty, while working, while on Company property, or while operating Company
or customer equipment, machinery, or vehicles;
• Is under the influence of alcohol and/or unauthorized drugs while on duty, while working, while on Company
property, or while operating Company or customer equipment, machinery, or vehicles;

prohibits employees’ use of, possession of or being impaired by marijuana during working hours and on Company
property even in jurisdictions that have authorized such use for medical or recreational purposes. Unless hiring or
maintaining the employment of an individual whose status as a marijuana cardholder would cause Footprint to lose
a monetary- or licensing-related benefit under federal law or regulations, Footprint shall not discriminate or retaliate
against a person in hiring or during employment, up to and including the termination of employment, by imposing
any term or condition of employment, disciplining or otherwise penalizing a person based upon such status as a
cardholder.
