WASHINGTON NATIONALS BASEBALL CLUB, LLC FLEXIBLE BENEFIT PLAN
ELIGIBILITY FOR PARTICIPATION
Eligible Employee
You are an “Eligible Employee” if you are employed Washington Nationals Baseball Club, LLC
(the “Company”), LLC or any affiliate who has adopted the Washington Nationals Baseball Club,
LLC Flexible Benefit Plan (the “Flex Plan”). However, you are not an “Eligible Employee” if you
are any of the following:
• A self-employed individual (including a partner), or a person who owns (or is deemed to
own) more than 2 percent of the outstanding stock of an S corporation.
• Covered by a collective bargaining agreement.
• A leased employee.
• A non-resident alien who received no U.S. earned income.
• A part-time employee who is expected to work less than 35 hours per week.
You are an “Eligible Employee” for purposes of the Premium Conversion Account on the date you
become eligible to receive benefits from the contracts described for Premium Conversion
Accounts in the Section titled "BENEFITS" below; but only if you are not a self-employed
individual (including a partner) and you are not a person who owns (or is deemed to own) more
than 2 percent of the outstanding stock of an S corporation.
Date of Participation
You will become a Participant eligible to receive benefits from the Flex Plan on the first day of
the calendar month coincident with or next following your date of hire or the date in which you
otherwise become an Eligible Employee.
However, you will become a Participant eligible to make contributions and receive benefits from
the Premium Conversion Account on the date you become eligible to receive benefits from the
contracts described for Premium Conversion Accounts in the Section titled "BENEFITS" below.
You will stop being a Participant eligible to receive benefits from the Flex Plan on the date you
are no longer an Eligible Employee or the date you terminate employment with the Company. But
see special rule for the Dependent Care Assistance Account under “Plan Year/Termination Date”
below.
ELECTIONS
In General
When you become eligible to participate in the Flex Plan, you may begin contributing to the Flex
Plan. Contributions pertaining to the Health Care Reimbursement Account or the Dependent Care
