Bills dealing with access to records include SB21-159. This bill was Republican sponsored
and would have prohibited the department of revenue from selling electronic bulk
transfers of DMV data. This bill was postponed indefinitely in its committee of
introduction.
Another records access, or rather records sealing bill is HB21-1214. This bill creates an
automatic sealing process for some records and creates a process for individuals with
multiple conviction records to be eligible for sealing. This bill easily passed through both
chambers despite having Democratic-only sponsorship and awaits the Governor’s
signature.
One licensing bill of note is HB21-1120. This bill concerned the licensing of private security
guards. This bill also had Democratic-only sponsorship, with one common sponsor with
HB1214. Interestingly though, this bill was pulled by the sponsor and never got past the
committee of introduction.
Colorado will likely continue to trend toward bills which address privacy concerns, as well
as bills that limit access to records and personal identifying information. Colorado is also
not alone. Other states have similar concerns. To make matters worse, privacy concerns
are a bipartisan topic for lawmakers. The investigative profession will need to reach out to
lawmakers early and often to educate and inform them of the impacts of such legislation.
