collection site designated by Big River. A list of drugs tested for is
outlined above in Section B.
1. The testing shall be conducted upon a sample from the
human body capable of revealing the presence of alcohol,
drugs, or their metabolites as "sample" is defined by the
Administrative Rules and Regulations of the Iowa Public Health
Department applicable to drug and alcohol testing under
Iowa Code Section 730.5, specifically urine, breath, and/or
saliva.
2. At the time of sample collection, employees may submit
information relevant to the test, including identification of any
prescription or nonprescription drug currently or recently used,
legal recreational substances, and/or other relevant medical
information. The Medical Review Officer (“MRO”) will evaluate
the information provided. This data is reviewed solely by the
testing company or MRO. No genetic information is requested
and will not be accepted.
3. If there is a confirmed positive drug or alcohol test, the
employee will be notified in writing by certified mail, return
receipt requested of the test results, the employee’s right to
request and obtain a confirmatory test, the test fee, and the
procedure to request a confirmatory test. A second test will be
conducted only if the employee, in person or by certified mail,
requests the second test, identifies an approved laboratory to
conduct the test, and pays the test fee within seven days of
receiving written notice of the test results. If the second test
does not confirm the positive result of the first test, the first test
shall not be considered a confirmed positive test result for the
purposes of disciplinary action, and Big River will reimburse the
employee for the fee paid by the employee for the second
test.
4. If the employee is a minor, such notice of the confirmed
positive drug or alcohol test will also be mailed to an identified
parent or legal guardian of the employee by certified mail,
return receipt requested.
5. Employees shall be entitled to receive records of a confirmed
drug or alcohol test. The request for records shall be directed
to Human Resources.
