        it lays the eggs that his property should not acquire the eggs. If so, he can still fulfill the mitzva, since they
        won’t belong to him and will not be considered in his possession.

        [With regard to] eggs that were laid in one’s possession, and   לבא ,םהמ םאה ההבגוהו ,ותושרב ולטוהש םיציב
        the mother was raised above them, but the owner didn’t   תווצמ םייקל לוכי םא ,םהב תוכזל ותעד התיה אל
        have intention to acquire them, can he still fulfill the mitzva           :ןקה חוליש
        of Shiluach Hakein?
                                                       ,תוריבב  םירופיצ  יבג  קרש  …רוציקב  בישא…
        …I will answer briefly… that only concerning birds in    תוריבה בשחנ סדרפב ונניקש םילוגנרתו םיזוואו
        ditches and geese and chickens that nested in an orchard    םאה ההבגוהשכ םיציבה הנוקש רצחכ סדרפהו
        are the ditches and fields considered like a courtyard that
        acquires the eggs when the mother is raised above them    םיציבב אלו ,ןהב תוכזל ותעדש םושמ ,םהילעמ
        because he has intention to acquire them, but not for eggs        .ןהב תוכזל ותעד ןיאש
        that he had no intention of acquiring.         םא  ,םילוגנרתו  םיזוואו  םירופיצ  יבג  ללכב  םגו
        And in general concerning birds, geese, and chickens, if   תוכזל הצר אלו ,וליבשב תוכז הז ןיאש ןעוט דחא
        one claims [afterwards] that it is not a merit for him and   לוכי אליממו .הנק אלו ,ערפמל םג ונימאהל שי –
        he didn’t want to acquire them, one can believe him even   .ןקה חוליש תווצמ םייקל ןיידע
        retroactively,  and  he  hasn’t  acquired  them.  Therefore,  he
        can still perform the mitzva of Shiluach Hakein.

        Some other contemporary poskim, including the Peninei Halacha (Kashrut Vol. 1, 16) and the sefer Shale’ach
        Teshalach (below source #17) agree with this suggestion of Rav Feinstein. By contrast, Rav Shlomo Zalman
        Auerbach argues that even in a case where one intends not to acquire the nest and the eggs, he still may
        not fulfill the mitzva, since at any moment he can acquire the nest through his courtyard if he so desires.
        Therefore, it is considered to still be mezuman, readily available to him.

        Regarding the suggestion… that even in a secured   רמול  לכוי  תרמתשמה  רצחב  םגש  …ןיינעב
        courtyard a person can make a condition at the outset   ורצח  ול  הכזתש  ללכ  הצור  וניאש  ,הליחתב
        and say that he has no intention that his courtyard should    םייקל לקב לכוי אליממו ,ליטת רופיצהש םיציבב
        acquire the eggs that the bird will lay, and therefore he will    יתעד תוינעלו .ןמוזמ הז ןיאד ןוויכ ,הווצמה תא
        be able to fulfill the mitzva with ease, as they will not be    ןכ  אל  םאד  ,ךכל  דעס  תצקו  …הזב  קפקפל  שי
        considered in his possession. But in my humble opinion    תלוגנרת םע בולכ ותיב ךות סינכהל םדא לכ לוכי
        this is very questionable… and there is some backing to
        my claim, as otherwise every person could bring a cage    לדגיל  וכרד  ןיאש  רחא  רוהט  ףוע  וא  ,הדרמש
        with a bird that was rebellious into his house, or another    רופיצה  םע  בולכה  תא  ףכית  ריקפהלו  ,תיבב
        kosher  bird  that  doesn’t  usually  live  in  one’s  house,  and    ,םהב  הצור  וניאש  םיציבה לע  םג  ותעד  תולגלו
        make the cage and bird ownerless immediately and reveal   …חוליש תווצמ לקב םייקל ךכ רחא לכויו
        his intention also regarding the eggs that he doesn’t want
        to acquire them, and he would thereby be able to fulfill the
        mitzva afterwards with ease…
