situations where they find if they have a child
that's six years older or younger, then we'll do
wage replacement as a part of the distribution.
While we have incorporated this provision in
many of our estate plans, it is far from a
template document that takes into account all
other facets of the estate plan. We are not
simply just “printing it out” for maximum
profit. It's really a part of the drafting piece. We
have similar solutions for homeschooling
support too, where an allowance is provided to
support homeschooling grandchildren so long
as one of the parents is leading the instruction.
A good lawyer should not shift the labor to the
client. We try and make it as easy as possible
for the client. We may have some follow-up
questions. We handle that with a direct
question like, "What is the legal name of your
eldest daughter? We didn't get that in the
interview. Or perhaps we missed the middle
initial, or we need their date of birth." It's not
so burdensome on the client that the
experience becomes un-enjoyable. I really
think that the estate planning experience
should be something between a husband a
wife that actually enhances their
