Summary (PN 3767) Amends Title 18 (Crimes and Offenses), in assault, further providing for the offense of
stalking to assert that a person commits the offense of stalking when the person knowingly or
recklessly places another person in reasonable fear of bodily injury or causes substantial emotional
distress. Effective in 60 days.

Consolidated Statutes, in juvenile matters, further providing for disposition of delinquent
child and for limitation on and change in place of commitment; and making editorial
changes.

(PN 3761) Amends Title 42 (Judiciary and Judicial Procedure), in juvenile matters, further providing
for disposition of delinquent child and for limitation on and change in place of commitment; and
making editorial changes. Replaces language to read that there shall be no financial condition
incorporated into a child’s case except for a contribution to the Crime Victim Services and
Compensation Fund or a $10 county restitution fund assignment and any reasonable amount
of restitution. Provides for restitution after determining that actual damages were suffered by
the victim due to the delinquent child’s actions and outlines the determination process. Adds
that restitution may only be ordered to an actual victim and that at every post-disposition review
proceeding, the court shall make findings as to the progress a delinquent child has made toward
satisfying the order for restitution and shall inquire as to the assistance given to the child by the
probation department and placement providers. Adds that the court may modify the order for
restitution and that if a delinquent child has satisfied all conditions of supervision other than the
payment, the court may forgive the unpaid amount. Provides for disposition reviews and outlines
the procedure. Provides for the removal of a child from the home if the child poses a risk to the
safety of a victim or the community for an offense committed, the child has been adjudicated of
a sexual crime and residential treatment is the most appropriate and least restrictive option or
the court determines that the child is medically in need of residential drug and alcohol treatment
or mental health services. Provides for exceptions. Prohibits the placement out of state, and the
extending of the placement unless an extension is necessary to complete an evidence-based
program, the child is found to be a significant risk to a victim or the community, the child has been
adjudicated delinquent for murder or a sexual offense or an attempt to commit those crimes or if
the court determines that the behavior under subparagraph (i) was a manifestation of the child’s
disability. Makes technical changes. Effective in 180 days.
