How to make online submission of application at State level since it
is processed through online portal PARIVESH and managed
centrally by Ministry of Environment, Forest and Climate change,
Govt. of India?
Under relevant provisions of Water (Prevention and Control of Pollution)
Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981, industries
are required to obtain Consent to Establish from State Pollution Control
Board (SPCB). In this regard, it is stated that SPCB’s are required to develop
an Online System having features mentioned in the action point.
Additionally, it is stated that PARIVESH portal of Ministry of Environment,
Forest and Climate Change does not deal with application for Consent to
Establish (CTE).

In the Order of the Hon’ble NGT in O.A. No. 639 of 2018 certain
observations were made relating to Policy of auto renewal in respect of
CTO. In light of the above judgement please advise on appropriate
implementation procedure that should be followed by States?
• States may provide for renewal of CTO after the business/ enterprise
uploads all the necessary documents as per the rules and procedures on the
respective portal of the SPCB based on which an assessment will be made.
The verification of documents is to be completed within a fixed time frame.
• SPCB will evaluate within a fixed time frame all documents and pollution
analysis reports and only upon satisfaction of all pollution related
compliances, SPCB should grant renewal of CTO.
