Other Liability Considerations
Now that we’ve examined the top risk issues as identified in
our claims data, let’s touch on a few other considerations when
entering into a collaborative relationship.
Contract
It is crucial that before entering into a legal agreement, all
parties should contract with a healthcare attorney specializing
in these arrangements. Paying an attorney for a few hours of
work before signing a contract could save significant liability
exposure. Each state medical society or nursing association
should have information about experienced attorneys to assist
providers.
Professional Liability Coverage
Nearly all physicians rely on the delegation of certain medical
services to other healthcare providers to some degree. The
supervision requirements and the corresponding liability
exposures can vary greatly depending on the complexity of
services provided by the APP.
What about insurance coverage for such liability exposure? In
essence, SVMIC’s medical professional liability insurance policy
covers the insured physician for legal liability resulting from the
acts or omissions of others for whom the insured physician is
legally responsible; or, if the employing practice entity is held to
be legally responsible, the practice entity’s policy would provide
the insurance coverage.
