SVMIC Collaborating with Advanced Practice Providers
for the APP’s negligence. Each state medical society should have
information about experienced attorneys to assist providers.
Professional Liability Coverage
Nearly all physicians rely on the delegation of certain medical
services to other healthcare providers to some degree. The
supervision requirements and the corresponding liability
exposures can vary greatly depending on the complexity of
services provided by the APP.
What about insurance coverage for such liability exposure? In
essence, SVMIC’s medical professional liability insurance policy
covers the insured physician for legal liability resulting from the
acts or omissions of others for whom the insured physician is
legally responsible; or, if the employing practice entity is held to be
legally responsible, the practice entity’s policy would provide the
insurance coverage.
Regarding supervision of, or collaboration with, advanced practice
professionals, the legal and regulatory requirements can vary
significantly from state to state and from one arrangement to
another. Such requirements may be different for advanced practice
professionals who practice remotely from the supervising or
collaborating physician. Therefore, it is critical for all involved to
understand and comply with the applicable legal and regulatory
requirements before entering into any such relationship.
