Claimant because the transfer has practically or legally become impossible regardless of whatever
reasons, the Respondent shall pay to the Claimant the sum of Baht 18,000,000 (Baht eighteen million
only).
The Respondent shall pay to the Claimant in respect of costs including the

arbitrators’ fees, administrative fees and expenses recorded by the office of Thailand Arbitration
Institute (TAI), except the lawyer’s fee payable by the Claimant to its counsel, incurred by the
Claimant in this arbitration proceeding.
