confidential nature of that Confidential Information and

their obligations in relation thereto; and

(e) not to record or keep the Confidential Information

disclosed to you in any documentary, electronic or other

form, whether permanent or transient once the
Competition is over.

6. The non-disclosure obligations expressed in this letter

agreement shall continue for a period of three years
from the date on which you sign below.

Exceptions to Non-Disclosure Obligations

7. The restrictions and obligations on you set out above,

shall not apply to any Confidential Information which:

(a) is or becomes generally available to the public other

than directly or indirectly through any act or default on

your part.

(b) was available to you on a non-confidential basis prior to

disclosure by UKTI or

(c) was, is or becomes available to you on a non-

confidential basis from a person who is not bound by a

confidentiality agreement with UKTI and is not otherwise
prohibited from disclosing the information to you.

(d) you are required to disclose by law, by any governmental

or other regulatory authority (including, without

limitation, the Information Commissioner or the First
