In this case the court considered the principles and values underpinning the public’s right to
an open Parliament.

(xvi) Land Access Movement of South Africa and Others v Chairperson of the Na onal Council
of Provinces and Others (Cons tu onal Court) case no: CCT 40/15
In this case the court considered the lawfulness of truncated melines for public
involvement.

(xvii) Marius Llewellyn Fransman v Speaker of the Western Cape Provincial Parliament and
Another (Western Cape High Court) case no: 13097/2014
In this case the court found that it is not for the judiciary to determine the internal
arrangements, proceedings and procedures of legislatures but that these ma ers are
reserved by the Cons tu on for determina on by the legislatures themselves. The court
also found that the proceedings of a parliamentary commi ee is not administra ve ac on
reviewable under the Promo on of Administra ve Jus ce Act, 2000.
