Family and Medical Leave Act
Job protection under FMLA
Texas Mutual is a covered employer under the Family and Medical Leave Act
(FMLA). The FMLA requires covered employers to provide unpaid, job-
protected leave for certain family, medical and military leave reasons to
eligible employees. You are an FMLA eligible employee if you have been
employed by Texas Mutual for at least 12 months and you have worked at
least 1,250 hours during the 12 months preceding your leave.
As a covered employer, Texas Mutual must provide eligible employees up to
12 weeks of unpaid, job-protected leave for eligible employees during any
12-month period, or up to 26 weeks to care for a covered service member, for
the reasons shown below. The 12-month period, is calculated using the rolling
12-month period measured backward from the date you use any FMLA leave.
If you have an event that appears to qualify under FMLA, contact Human
Resources. Your supervisor will also request that you contact Human
Resources, and your supervisor may notify Human Resources on your behalf.
Qualifying events under FMLA
One or more of the following reasons may qualify for FMLA leave:
■ For incapacity due to pregnancy, prenatal medical care or childbirth;
■ To care for your child after birth, or placement for adoption or foster
care during the child’s first year of life or during the first year following
such placement;
■ For a serious health condition that makes you unable to perform the
essential functions of your job.
■ To care for your child, spouse, or parent, who has a serious health
condition.
■ Because of a qualifying exigency arising out of the fact that your
spouse, son, daughter, or parent who is a member of the Armed
Forces (including the National Guard or Reserves) and who is on
covered active duty (i.e., deployment to a foreign country) or has been
notified of an impending call or order to covered active duty status.
■ To care for a covered service member (current member of Armed
Forces or a covered veteran which includes the National Guard or
Reserves) with a serious injury or illness if you are the spouse, son,
daughter, parent or next of kin of the covered service member.
