(a) Processing and settlement of claims requires
sound knowledge of which areas - For processing
and settlement of claims, one should have a sound
knowledge of (i) the general law of contact. (ii) the
special law of contract, i.e the principles of common
law, as applicable to fire insurance, viz, indemnity,
subrogation, utmost good faith etc. (iii) the terms,
exceptions and conditions of (a) the fire policy (b) the
extensions of the policy and (c) the special policies and
clauses.
b. Onus of proof - This refers to the task or duty imposed
on someone to prove that what he has affirmed is true.
Under a fire policy, the onus of proving that the loss
resulted directly from fire, is on the insured.
It is sufficient to prove that the loss resulted due to fire,
he does not have to prove the cause of fire. Once proven,
