Enroute Motorcycle Insurance
EXTENSIONS
1. Disappearance
In the event of the disappearance of the Insured in circumstances which reasonably sa s es the Company that the Insured has sustained bodily injury and that such bodily injury has resulted in the death of the Insured immediately prior to their disappearance, the Company will presume the Insured's death and pay such death bene ts as may be applicable under the Policy;
PROVIDED THAT:
if a er the Company has made payment of such bene t, the Insured is found to be alive, such bene t shall forthwith be refunded to the Company by the Insured or the Insured's estate as the case may be.
2. Exposure
Bodily injury shall include injury caused by starva on, thirst and/or exposure to the elements directly or indirectly resul ng from a Motorcycle Accident.
3. Terrorism
Notwithstanding anything to the contrary in Excep on 1 to this Sec on, the insurance provided by this Sec on, is extended to cover Death, Permanent Total Disability, and/or Medical Expenses arising from "Terrorism ac vity" as de ned in the Protec on of Cons tu onal Democracy against Terrorist and Related Ac vi es Act, 2004 as amended;
PROVIDED THAT:
the Company shall not be liable to pay any Bene t in respect of the Insured arising from:
3.1 the performance by the Insured of obliga ons in terms of the Defence Act, 2002, or the South African Police Services Act, 1995 at a place from which military or police ac ons are carried out; or
3.2 consequent upon such person's actual engagement in military or police ac ons.
4. Hijacking
The Policy is extended to cover bodily injury to the Insured in the event of unlawful seizure or wrongful exercise of control of a motorcycle on which the Insured is being conveyed by means of violence or threatened violence.
EXCEPTIONS
The Company shall not be liable to pay any bene t for any claim directly or indirectly consequent upon:
1. war invasion, act of foreign enemy, hos li es (whether war be declared or not), civil war, rebellion, military or usurped power or whilst the Insured is on ac ve service with the military, naval, air or police services of any na on;
2. par cipa on in labour disturbances, riot, strikes, lock out or the Insured commi ng a criminal o ence;
3. wilful exposure to danger (except in an a empt to save human life), inten onal self-in icted injury, suicide or a empt thereat;
4. or caused by or contributed to by any pre-exis ng physical defect or deformity or sickness or disease or any condi on for which the Insured had received treatment, or medical advice, prior to the date of the Motorcycle Accident;
5. the Insured travelling on a motorcycle whilst engaging in racing or speed or dura on tests of any kind, or whilst the Motorcycle is being used for any purpose other than that for which it was built and registered;
6. the Insured being the driver of the vehicle or conveyed on a Motorcycle driven by a driver whilst such driver is not in possession of a valid driver's licence authorizing him or her to drive the Motorcycle;
