Judgment Enforcement – The Step-by-Step Course

Generally, what you do after preparing the Assignment Order:

Step 1: Call the court and get a date for the motion.
Step 2: Submit the paperwork to the court and pay the fee.

Step 3: Have the debtor properly served with the
paperwork.

Step 4: Get the proof of service filed at the court.

Step 5: Appear in court at the specified date and time.

Step 6: Send a copy of the Order to the person who is
supposed to pay the debtor.

So, you serve a copy of the Court Order on the person who is supposed to pay, and
include a short note giving them your mailing address. Be polite, but very clear in
explaining to them that they will be in Contempt of Court if they don’t pay.

Usually the person paying the debtor won’t mind paying you instead. It is same amount
of money they are obligated to pay either way, so it’s just a matter of who they send it to.
However, knowing they will be in contempt of court if they don’t send it to you

encourages them to cooperate.

Super note: The Assignment Order process may look long and hard, but the
only difficult part is the wording of the Pleading Papers that go to the court.
Craft your words as carefully as you can. Get help if you need it. The court
knows you are not an attorney and will cut you some slack as long as your
request is within the law and your request is worded with some care.
