Judgment Enforcement – The Step-by-Step Course




                    Here’s some sample cases. Pretend you located these judgments, or that someone just
                    called you with each. I’ll lay out the fact pattern, and what your research discovers, so I
                    can show you how I research a case.

                                                        Sample Case #1


                          Through your investigations, you turn up a case with the following fact pattern:

                          1.  Case name: Betty Roberts v. Ted Rivers
                          2.  Date of judgment: December 5, 2018

                          3.  “Cause of Action” (Reason for judgment): Failure to pay back money that was
                              loaned.
                          4.  Amount: $9,756
                          5.  Default judgment?: No  (Defendant did show up to defend and lost.)
                          6.  Not a consumer judgment

                    Back at the office, you run your Lexis, TLO (etc.) database and you discover:

                       ✓  Ted is age 36

                       ✓  he has not filed bankruptcy,
                       ✓  he has moved since the judgment,

                       ✓  he moved 3 times in the last year

                       ✓  he is renting
                       ✓  his rent is about $4K a month (you ran Zillow approximation or Googled the

                           apartment complex)
                       ✓  his last rental home was about the same amount

                       ✓  Ted is married
                       ✓  he is driving a 2015 Toyota Rav

                       ✓  has started no business

                       ✓  he has a tax lien for $500 against him
                       ✓  he has another judgment against him for $3,200 from Capital One

                       ✓  he still works or used to work for Auto Safe car window repair
                       ✓  he has no criminal record, not even speeding

                       ✓  he went to Ohio Univ for 2 years
