This new law removes a loophole that allowed adults to use hand-held devices to send, receive or read
text messages while driving.
As is the case for violating the existing cell phone law, police will be able to pull over adults found
doing any of the above.
Violators will face at least $20 fines plus additional penalties. Subsequent offenses would result in up
to $50 fines.
No violation points will be given as a result of the offense and there are exceptions for emergency
personnel.
As a reminder, there are still several exceptions to the law, including making an emergency call to a
police agency,
fire department medical provider or other emergency services provider.
California Text Messaging Ban | Senate Bill 28
SB 28, Simitian. Motor vehicles: electronic wireless communications device.
(1) Under existing law, on and after July 1, 2008, it is an infraction for any person
to drive a motor vehicle
while using a wireless telephone, unless that telephone is designed and configured to
allow hands-free listening
and talking operation, and is used in that manner while driving, except as otherwise
provided. A violation
point is not given for a violation. A violation is punishable by abase fine of $20 for a
first offense and $50
for each subsequent offense.
This bill would also prohibit a person from driving a motor vehicle while using an
electronic wireless communications
device to write, send, or read a text-based communication, except as specified.
The bill would also provide that a violation point is not given for a violation of these
provisions and would impose
a base fine of $20 for a first offense and $50 for each subsequent offense.
By creating a new infraction, the bill would impose a state-mandated local program.
