Safety Memo #26 (W) AB 685 & Cal/OSHA Section 3205 COVID-19 Prevention Requirements

[ AB 685 & Cal/OSHA Section 3205 COVID-19 Prevention Requirements ]
With the rising numbers of COVID-19 cases, California has passed AB 685 to lay down new requirements for
COVID-19 prevention and has given Cal/OSHA the authority to close workplaces based on the threat of
COVID-19. AB 685 will go into effect starting January 1, 2021 and expires on January 1, 2023.
***In order to effectively comply with AB 685, all COVID-19 cases (probable and confirmed) must be reported
to Brian Shin—Safety Administrator—and Chris Kim—Sr VP HR—IMMEDIATELY.
Please see below for the new mandatory protocol based off AB 685 and Title 8 §3205:
1. A written notice must be sent out within one day of notice of potential exposure.
a. Provide a written notice to all employees and employers of subcontracted employees who were
on the premises at the same time as the suspected individual that they may have been exposed
to COVID-19.
b. Please see below for a template “Notice of Workplace Exposure to COVID-19” that may be
used to inform all potentially affected individuals. Highlighted items can be replaced with
incident specific information.
2. The Local Public Health Agency must be notified of any outbreaks within 48 hours. Per AB 685, an
outbreak is defined as “at least three probable or confirmed cases of COVID-19 within a 14-day period
in people who are epidemiologically-linked in the setting, are from different households, and are not
identified as close contacts of each other in any other case investigation.”
3. Per Title 8 §3205 “COVID-19 Prevention,” Cal/OSHA must be notified of any COVID-19 related serious
illness or death (as defined under section 330(h)) of an employee occurring in a place of employment or
in connection with any employment.
NOTICE OF WORKPLACE EXPOSURE TO COVID-19
We have been notified that an individual who was on site [EXPOSURE DATES] is being evaluated for
COVID19. As such, employees working at [WORKSITE NAME] may have been exposed to this virus.
According to the CDC, the virus is spread mainly between people who are in close contact with one another
through respiratory droplets produced when an infected person coughs or sneezes.
We have reached out to those employees believed to have been in close or direct contact (direct contact
means being within 6 feet for a period of 15 minutes or more over a 24-hour period) with the subject employee
so that they may take appropriate protective measures for themselves and on behalf of all ACI associates,
including the possibility of remaining at home for a 14-day quarantine period. If you experience any symptoms
of COVID-19 (fever, coughing, shortness of breath), please inform [ACI EMPLOYEE] and contact your health
care provider.
ACI will keep all medical information confidential and will only disclose it on a need-to-know basis.
ACI is taking measures as described in prior Safety Memos distributed to all ACI employees on COVID-19
prevention to ensure the safety of our employees and subcontractors during this pandemic and we will keep
you informed as the need arises.
