offending conduct. Anyone who has observed an alleged violation of this policy is
also expected to promptly bring the same to the attention of his or her Supervisor or
the Human Resources Department.
Molzen Corbin is committed to a policy ensuring the work environment is free
from sexual harassment. No member of Molzen Corbin should be subject to
unsolicited or unwelcome sexual overtures. Molzen Corbin is prepared to take
disciplinary measures up to and including termination for any violation of this
policy.
Sexual harassment refers to conduct that affects a person’s work performance by
creating an intimidating, hostile, or offensive work environment that impedes a
person’s ability to perform job duties. In determining whether an act is sexual
harassment, the federal government has issued the following guidelines: Title VII
of the Civil Rights Act of 1964 prohibits “unwelcome sexual advances, request for
sexual favors, and other verbal and physical conduct of a sexual nature,”
particularly in situations where:
Submission to such conduct is either an explicit or implicit term or condition of
employment or advancement;
Submission to or rejection of such conduct is used as the basis for decisions
affecting an individual’s employment or advancement; or
Such conduct has the purpose or effect of interfering with a person’s work
performance or creating an intimidating, hostile, or offensive work
environment.
Each member of Molzen Corbin plays an important part in creating an atmosphere
free from all forms of discrimination and harassment, including sexual harassment.
Any incident of alleged sexual harassment or other forms of discrimination must be
reported immediately.
In the event of reporting such an incident, Molzen Corbin will ensure the
following:
There will be no retaliation against the person reporting the incident and any
employee participating in the investigation;
The matter will be discussed only with those on a need-to-know basis;
The matter will be investigated thoroughly and objectively; and
Prompt action will be taken against anyone in Molzen Corbin found guilty of
conduct that violates Title VII or the New Mexico Human Rights Act.
