laboratory designated by Molzen Corbin. Confirmatory testing at a laboratory
designated by the Company will follow all positive initial screening tests. All
testing will be conducted in a manner that balances the privacy interests of the
employee with the need to ensure proper specimen collection and to prevent
tampering with or contamination of specimens. Any individual found to have
tampered with a specimen or to otherwise have interfered with the testing
procedure will be subject to discharge, regardless of the test results.
5. Test Results. A “negative” test result will indicate that alcohol or prohibited
drugs have not been detected in the employee’s system at defined cut-off levels.
However, a negative test result will not preclude Molzen Corbin from
disciplining the employee for unacceptable job performance or the violation of
other Company policies. A “positive” test result will indicate the presence of
alcohol or prohibited drugs in the employee’s system and will subject the
employee to discipline up to and including discharge.
6. Confidentiality. Molzen Corbin will endeavor to maintain the confidentiality of
all test results. Information related to investigations conducted pursuant to this
policy will be disseminated on a need-to-know basis in order to further the
objectives of this policy and to comply with other Company policies or legal
obligations. Tests that are paid for by Molzen Corbin are the property of
Molzen Corbin, and the examination records will be treated as confidential and
held in separate medical files. However, records of specific examinations, if
required by law or regulation, will be made available to the employee, persons
designated and authorized by the employee, public agencies, relevant insurance
companies or the employee’s personal physician. Records regarding drug and
alcohol testing will be retained in the employee’s confidential Medical /
Insurance file.
7. Procedure for Drug Testing. All drug and alcohol testing under Molzen
Corbin’s Drug Testing Policy will be conducted by an independent testing
facility licensed by the state, which will obtain the individual’s written consent
prior to testing. Molzen Corbin will pay for the full cost of the test. Employees
will be compensated at their regular rate of pay for time spent submitting to a
drug and alcohol test required by Molzen Corbin.
Employees suspected of working while under the influence of drugs or alcohol
will be suspended without pay until Molzen Corbin receives the results of a
drug and alcohol test from the testing facility and any other information Molzen
Corbin may require to make an appropriate determination.
