45. JUSTICES – Murder–(Human) (Subject to change based on the level of
violation.).
a). Murder – first degree: the term that describes the killing of a person that has
been planned and carried out with malice. (reference from – Black's Law
Dictionary)
Offense: Compensation for victim – burial expenses & damages paid to
victim's family, removed from the tribe for life.
b). Murder – second degree: term that is given to a killing of a person that was
not premeditated but came from a desire to inflict harm. (reference from –
Black's Law Dictionary)
Offense: Compensation for victim – burial expenses & damages paid to
victim's family, 5–15 years confinement & a fine of $5,000.00 to
$10,000.00.
c). Murder – third degree: this is the term that describes a murder committed
while a felony is committed. (reference from – Black's Law Dictionary)
Offense: Compensation for victim – burial expenses & damages paid to
victim's family, 5–10 years confinement & a fine of $3,000.00 to
$5,000.00.
d). Attempted Murder: term used when a person has planned to kill another
person and was unsuccessful. (reference from – Black's Law Dictionary)
(There are different degrees of attempted murder charges. A first-degree
attempted murder charge requires premeditation or a willful act; a
second-degree attempted murder charge is any other act that is not
