1.7.25 "Mortgagee of a Unit" means the holder of a Mortgage on a Unit, which
mortgage was recorded simultaneous with or after the recordation of this Declaration. Unless the
context requires otherwise, the term "Mortgagee of a Unit" shall also be deemed to include the
Mortgagee of the Condominium.
1.7.26 "Occupant" means anyone who occupies a Unit as a permanent residence
or who stays overnight in any Unit more than fourteen (14) days in any calendar month or more
than sixty (60) days per calendar year. The Board, at its discretion, may grant exception to these
time periods upon written request.
1.7.27 "Person" means a natural person, corporation, partnership, limited
partnership, limited liability company or partnership, trust, governmental subdivision or agency,
or other legal entities.
1. 7.28 "Property" or "Real Property" means any fee, leasehold or other estate or
interest in, over, or under the land described in Exhibit A, including buildings, structures,
fixtures, and other improvements thereon and easements, rights and interests appurtenant thereto
which by custom, usage, or law pass with a conveyance of land although not described in the
contract of sale or instrument of conveyance. "Property" includes parcels, with or without upper
or lower boundaries, and spaces that may be filled with air or water, and all personality intended
for use in connection therewith.
1.7.29 "Purchaser" means any person, who by means of a Disposition acquires a
legal or equitable interest in a Unit other than (a) a leasehold interest, including renewal options,
ofless than twenty years at the time of creation of the Unit, or (b) as security for an obligation.
l.7.30 "Related Party" means a person who has been certified in a written
document filed by a Unit Owner with the Association to be the spouse, parent, parent-in-law,
sibling, sibling-in-Iaw, parent's sibling, or lineal descendant or ancestor of the Owner, the
member of any Owner which is a limited liability company, the trustee or beneficiary of any
Owner which is a trust, or the partner of any Owner which is a partnership. Notwithstanding the
foregoing to the contrary, a person who is the settlor and trustee of a living trust that owns a Unit
shall be deemed to be the Owner of the Unit for all purposes under the Declaration.
l.7.31 "Renting or Leasing" a Unit means the granting of a right to use or occupy
a Unit, for a specified term or indefinite term (with rent reserved on a periodic basis), in
exchange for the payment of rent (that is, money, property or other goods or services of value); or
the occupancy of a Unit solely by a person other than its Owner or a Related Party, whether or
not rent is paid; but shall not mean and include joint ownership of a Unit by means of joint
tenancy, tenancy-in-common or other forms of co-ownership, or the occupancy of a Unit by a
person who resides in a Unit with its Owner or a Related Party, whether or not rent is charged
therefore.
1.7.32 "Residential Purposes" means use for dwelling or recreational purposes, or
both, as defined under Section 11 .1.
