When a regulatory agency makes a decision, it may impact a private party’s civil liberties, ultimately resulting in litigation.
While no one wants to be a named party in a lawsuit, these decisions impact government employees and the agency
they represent. This session will explore various governmental immunities and applicable circumstances that may affect
potential damages and how a lawsuit against the government may be styled to collect any damages and attorney’s fees.

Lawsuits and court cases continue to grow as enterprising attorneys look to take advantage of undefined terms, grandiose
marketing descriptions and exaggerated label claims such as “craft” and “hand-made.” While many of these may never
be adjudicated, there have been settlements in the hundreds of thousands of dollars that do nothing but increase the
amount of plaintiffs’ fees. If the TTB and state government approve a label, should it be granted immunity? Who wins in
a contest of “Truth in Advertising” against “Freedom of Speech”? While some may complain these lawsuits are frivolous,
legitimate questions have been raised. This session will look at the issues that bring about these kinds of lawsuits and
possible changes for product descriptions.

how courts and ethics tribunals might interpret various hypothetical fact patterns.
