%u201cSo whoever sights [the new moon of] the month, let him fast it; and whoever is ill or on a journey - then an equal number of other days. Allah intends for you ease and does not intend for you hardship and [wants] for you to complete the period and to glorify Allah for that [to] which He has guided you; and perhaps you will be grateful.%u201d [Al-Baqara, 2:185]As for the paying of the fidya, Imam Shafi%u2019i and Imam Ahmad use the actions and rulings of the companions regarding this issue; the companions would not have ruled in favor of the fidya had they not heard the Prophet (pbuh) himself say that it needs to be paid. The majority of the scholars do not follow this opinion that a fidya needs to be paid because there is no clear evidence of the Prophet (pbuh) affirming this.What is the detailed analysis of the fourth opinion which states that the pregnant or nursing woman does not need to make up the days and nor does she need to pay a fidya?This opinion, which is that of Imam ibn Hazm, states that in the following hadith, a special allowance was given to the traveler and the pregnant or nursing woman, in which the obligation of fasting was dropped and was not replaced with any other act of worship:Narrated by Abu Dawood, al-Tirmidhi, al-Nasaa%u2019i, and ibn Maajah:The Prophet (pbuh) said: %u201cAllah has relieved the traveler of half the prayer and of the duty to fast, and He has relieved pregnant and nursing mothers (of the duty to fast).%u201d Classed as saheeh by alAlbaani in Saheeh abi DawoodThe rebuttal from the majority of the scholars is that this hadith needs to be combined with the verses on fasting in the Qur%u2019an in order to make the ruling.
